Rep. Duncan Celebrates Supreme Court’s Ruling in Kerr v. Planned Parenthood South Atlantic

Washington, D.C. — Congressman Jeff Duncan released the following statement regarding the Supreme Court’s Tuesday decision in Kerr v. Planned Parenthood South Atlantic.

“The Supreme Court’s Kerr v. Planned Parenthood ruling is yet another win for life! As we eagerly await the Fourth Circuit’s review of South Carolina’s decision to defund Planned Parenthood, I trust the Court will rightly find that States are not forced to fund abortion providers like Planned Parenthood. Planned Parenthood is a pro-abortion activist group that has no place on South Carolina’s list of Medicaid providers because abortion is not health care. I commend South Carolina Governor Henry McMaster for ensuring taxpayer dollars are not used to fund abortions, and I thank over 100 of my colleagues in the House and Senate who joined me last year in petitioning the Court to review this vital case as we fight to defend life and protect the rights of unborn children.”

Background: The Kerr v. Planned Parenthood South Atlantic ruling remands the case back to the Fourth Circuit for consideration. This overturns last year’s decision from the U.S. Court of Appeals for the Fourth Circuit that allowed Planned Parenthood to be listed as a South Carolina Medicaid Provider, considering the Supreme Court’s recent decision in Health and Hospital Corporation of Marion Cty v. Talevski. In May 2022, Congressman Duncan and South Carolina Republicans led more than 100 Members of Congress in filing an amicus brief asking the Supreme Court to take up the Kerr v. Planned Parenthood South Atlantic case.
